1. Acceptance of Terms

By accessing or using TrueForm Digital Solutions ("TrueForm," "we," "us," or "our") services, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our services.

2. Description of Services

TrueForm provides professional website development, design, and related digital services including:

• Custom website design and development
• E-commerce solutions
• Content management systems
• Website hosting and maintenance
• Digital marketing consultations

3. Service Packages and Pricing

Base Package ($999)

Our standard package includes:

• Design discovery consultation
• Custom homepage design
• 2-3 supporting pages
• Mobile-responsive design
• Content management system
• One revision round
• First year hosting and SSL certificate
• 24-hour designer support

Add-On Services

Additional services are available at flat rates as specified in your proposal. All pricing is subject to the terms in your signed proposal.

Payment Terms

• Deposit: 25% due upon project acceptance to secure your spot
• Final Payment: 75% due upon project completion and your approval
• Payment Methods: Credit card, ACH bank transfer via Stripe
• Late Payments: 1.5% monthly service charge on overdue amounts

4. Project Timeline and Delivery

We commit to delivering your website within 7 business days of receiving:

• Signed proposal and deposit payment
• All required content and materials
• Completed design discovery questionnaire

Delays in providing materials or feedback may extend the timeline. Complex projects may require additional time as outlined in your proposal.

5. Client Responsibilities

You agree to:

• Provide accurate and complete information
• Supply all necessary content, images, and materials
• Respond to requests for feedback within 48 hours
• Make timely payments according to the agreed schedule
• Respect our team's time and professional boundaries

6. Revision Policy

Our base package includes one round of revisions:

• Revisions must be requested within 5 business days of initial delivery
• Additional revision rounds available for $200 each
• Minor updates (typos, color adjustments) are included for 30 days post-launch
• Major changes or scope increases require a new proposal

7. Hosting and Maintenance

Included Hosting (First Year)

• Professional website hosting
• SSL security certificate
• Basic security monitoring
• 99.9% uptime guarantee

Ongoing Hosting ($15/month)

After the first year, hosting continues at $15/month or $150/year if paid annually.

Maintenance Services

Optional maintenance packages available separately for content updates, security patches, and performance optimization.

8. Intellectual Property

Your Content

You retain all rights to content you provide (text, images, logos, etc.). You grant us license to use this content for your project.

Our Work Product

Upon full payment, you receive:

• Full ownership of the custom website design
• Rights to all custom code written for your project
• Access to all project files and assets

Third-Party Elements

Some elements may be licensed from third parties (fonts, stock images, plugins). These remain subject to their original licenses.

9. Warranties and Disclaimers

Our Warranties

• Website will function as designed on modern browsers
• Code will be free from major defects for 30 days post-launch
• Hosting services will maintain 99.9% uptime

Disclaimers

EXCEPT AS EXPRESSLY SET FORTH HEREIN, WE PROVIDE SERVICES "AS IS" AND DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10. Limitation of Liability

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR BUSINESS INTERRUPTION.

11. Cancellation and Refunds

Client Cancellation

• Before Work Begins: Full refund minus 3% processing fee
• After Work Begins: Refund of remaining balance after deducting completed work
• After Delivery: No refunds, but we'll work to address legitimate concerns

Our Right to Cancel

We reserve the right to cancel projects for:

• Non-payment or repeated late payments
• Abusive or unprofessional conduct
• Requests for illegal or harmful content
• Failure to provide necessary materials after 30 days

12. Prohibited Uses

You may not use our services for:

• Illegal activities or content
• Spam, malware, or phishing
• Hate speech or discriminatory content
• Adult content or gambling (without special approval)
• Activities that violate others' intellectual property rights

13. Indemnification

You agree to indemnify and hold harmless TrueForm and its employees from any claims, damages, or expenses arising from:

• Your use of our services
• Content you provide
• Your violation of these Terms
• Your violation of any third-party rights

14. Governing Law and Disputes

These Terms are governed by the laws of Texas, United States. Any disputes will be resolved through:

• First: Good faith negotiation
• Second: Binding arbitration in Austin, Texas
• Exception: Either party may seek injunctive relief in court

15. Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, pandemics, government actions, or technical failures of third-party services.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Changes to Terms

We may update these Terms periodically. Material changes will be communicated by:
